Queensland father fined for leaving window open

A Brisbane father who left his car window open a crack to let the heat out on a hot summer's day has copped a $44 fine for having an unsecured vehicle.

Julian Harris, 21, alleges he left his car window open only "three to four" centimetres when he was visiting family on Sunday in Brisbane's north.

"It was 34 degrees so I left the windows down slightly so it wouldn't be boiling hot for my 3-year-old son when we got back in," Mr Harris told the Courier Mail.

The father said it was "just what you do with it being so hot in Queensland".

According to a Queensland's road rules, if a driver is more than 3ms from their car it must be secure unless it is attended by someone over the age of 16.

Securing the vehicle includes having the windows up rolled up, but a "gap of 5cm or less is acceptable".

Mr Harris said that the officer informed him that the window was not properly measured by the fining officer who just said he had an "accurate eye".

Queensland Police did not deny that they were currently targeting this particular offence, but a police spokeswoman said that "Vehicle security remains part of ongoing Community Safety and Crime Prevention strategies designed to help reduce property crime".

It's quite sad what some people do these day's for money...

Every one for those fines is more money for the government.

I heard that the emergency services get paid extra for arriving to calls.

Interesting law - can't say I'd heard about it before. Seems to make sense in the right context, although I'm not sure about the whole 3m component. You have to draw the line somewhere though.

Would be a pretty easy one to have evidence of - a simple photo of the gap with a common item for reference.

TheCrazyRussian: It's not like the officer gets any of the money from fines. (At least I hope they're aren't on commission ) What is the point of laws if they are not enforced?

Channel 9 news tonight stated that police performance will be individually monitored and one of the criteria will be the number ft tickets issued . Went on to say that they will not be on a quota.

Wish that booty had not been booted would be interested in what he had to say,.

Maybe we need to reboot booty and bring him back

Archaic law. Especailly since every car sold in Australia since 2001 has an immobiliser fitted to comply with ADR.

Having the windows wide open won't assist a car thief in the slightest as they have no hope starting the car.

Always thought this was a stupid law. Means if your opening a gate you have to shut the car off and lock it when opening the gate, restart and move the car, shut it off, relock it, shut the gate, then restart it.

Enforcing this law cant be seen as anything other than revenue raising.
